Research On Legal Issues Related To Evidence Of Bribery Cases

In recent years, the bribery crime presents many new characteristics.The problems such as the single character, the instability and the complexity of the evidence in the bribery case have become the common concern of the procuratorial organs at all levels. In this paper, the legal characteristics and classification of the evidence of bribery cases are summarized, and the standard of proof is analyzed, and it is pointed out that the standard is important in the theory and practice of criminal proceedings. From the standard of proof in the common law system and civil law system, the standard of proof in criminal procedure in China is put forward. At the same time, in view of our country in the bribery case evidence collection aspect present situation, lists the existence main question, and proposed the suggestion of collecting evidence. At last, this paper tries to construct the special system of evidence of bribery cases in China through the study of the special system of the bribery presumption and the criminal immunity of tainted witness in other countries. In this way, to strengthen and improve the investigation and evidence collection of bribery cases, the establishment of a more scientific and reasonable evidence system will benefit the system of bribery.
