Bribery Criminal Investigation And Evidence Collection And Countermeasures To Improve The Level Of Evidence Collection

Bribery crime occupies a considerable proportion in the duty crime,it takes the illegal possession for the purpose,uses the position convenience,for the benefit for others.With the continuous development of social economy and the enhancement of national staff anti-detection consciousness,corruption and misappropriation of public funds have become a high incidence of bribery crimes in the past,and show different new features and new situations,mainly in the increasingly complex subject of crime,the diversity of criminal means,the improper use of money and stolen goods,the renovation of anti-detection means and so on.These new situations and new problems bring great difficulties to the investigation and evidence collection of the case handling organs.This paper starts with the characteristics of bribery crime,analyzes its characteristics,combined with the problems encountered in the investigation practice,and puts forward the solution to the problem.This article is divided into parts:The first part is the overview of bribery investigation.Starting from the characteristics of bribery crime,this paper introduces the characteristics of bribery crime and the evidence of bribery,and focuses on the investigation methods of several bribery crimes.The second part is a few difficult points in the process of bribery investigation.There are many difficulties in bribery crime,this paper can not discuss one by one,but only select several representative problems in the investigation practice.This paper focuses on the analysis of the " one-to-one" problem,zero confession,illegal evidence exclusion,lawyers in the investigation of intervention and technical investigation issues.These five problems are often encountered in the investigation and do not have effective solutions to the problem,to the investigation of the case brought great trouble.The third part is the strategy and application of bribery investigation and evidence collection.In view of the difficulties in the investigation and evidence collection of bribery crime,I put forward some solutions.This paper focuses on the interrogation strategy,investigation techniques and the collection of verbal evidence in the three aspects of interpretation.The so-called benevolence,the above three aspects are the summary of my five years of investigation experience,although said that can not fundamentally solve the problem,but should be the case investigators can be able to quickly apply to the practice of detection methods.The fourth part raises the countermeasures of improving the level of investigation and evidence collection in bribery crime cases.Solving the problems in the investigation of bribery crime can not meet the urgent needs of solving the problem,but to establish a long-term mechanism,fundamentally solve it.Combined with the investigation practice,I focus on how to improve the level of investigation and evidence collection in bribery crime cases from seven aspects.One is to change investigation mode;Second,improve investigation ability;Third,give full play to the role of preliminary investigation;The fourth is to improve the level of technical support;Fifth,strengthen the construction of information and information work;Sixth,to build the illegal evidence exclusion early warning mechanism;The seventh is to improve the strategy of dealing with lawyers.
