| "Venture capital" is just like a regulator of social resources.Venture capital enterprise can take full advantage of idle funds to solve the emerging enterprises which lack the original start-up capital.However,because of opportunism and the legal risk,which leads to some venture capital enterprises which against criminal laws frequently in fund-raising activities.This not only brings great damage to the enterprise and its managers,but also poses great threat to the security of investors' investment,which seriously affects the stability of venture capital market and the social and economic order.This paper is divided into three parts:introduction,text and conclusion.Firstly,analyzing and summing up venture capital enterprise fund-raising criminal legal risk one by one and combing with the relevant laws and regulations and criminal legal risk cases of venture capital in Chinese network(2010-2016).Secondly,because management of venture capital enterprise is not completely rational;the venture capital enterprise lack venture capital enterprise legal risk prevention system and risk investment enterprises financing business operation which is analyzed the above.Finally,the paper builds a set of risk investment enterprises from the criminal legal risk prevention and control mechanism as follows.First,improve the management mechanism and law-abiding awareness of prevention and control from the individual level,from the level of mechanism of auxiliary management decision-making;second foreign advanced risk investment industry experience,the establishment of venture capital enterprise compliance management system;third,reference good practice reform in a firm in China,standardize the investment risk enterprise funds for business operations. |
