On China's Foreign-related Legal Inheritance Notarization And Its Legal Application

With the increasingly close international contracts of different countries,rapid development of commodity economy and frequent exchanges among peoples,foreign inheritance cases growing proportion of all the inheritance cases.Inheritance is an ancient legal system,includes testament succession system,legal system and vacant succession.In this paper we focus on how Chinese Notarial Public Office deals with foreign inheritance cases with the background of the foreign statutory succession.According to the current Chinese legal system,more heirs choose to solve an foreign inheritance cases by notary than by litigation.Before the public of "Laws applicable law on foreign-related civil relationship",it's a difficulty for domestic Notarial Public Office to deal with foreign inheritance cases.Although the law was public now,the monotony point of junction can't suit for the complicated and confused cases.This paper mainly analyzes the characteristics and the actual situation of the foreign inheritance cases solved by Chinese Notarial Public Office by chart and case analysis,discuss how Notarial Public Office deals with these kind of cases and how to choose proper law.On this basis,put forward my own views.
