Residential surveillance is ordered to the criminal suspect or defendant shall not be allowed to leave the accommodation within a certain period of time or the designated residence,and the action to monitor the force method,is a kind of special coercive measures of our country.From the aspect of legislation,residential surveillance plays a positive role in many aspects,such as,guaranteeing the whole criminal procedure smoothly,reducing and preventing new danger of society,reducing custody of criminal suspects and defendants and greatly protecting the legal rights and interests of the suspects and the defendant's.On March,2012,which was adopted and examined and passed,specified the residential surveillance(hereinafter referred to as "designated residential surveillance")to become a new regulation in residential surveillance.Regulations have a great disturbance in the legal profession.Many people think that this is a retrogression of enforcement measures,and in the actual implementation process there are many unclear problems to be resolved.A lot of loopholes about the security of the suspect and the defendant appeared,leading to detrimental custody,suspect escape,self-injury,self-mutilation and even suicide.In order to solve this problem,it is necessary to put forward the legislative and judicial practice suggestions from the possible risks of the application of the designated residential surveillance.It is expect that the designated residential surveillance can be more clearly stipulated in the legislation and effectively in practice to solve many problems in practice.
