The Research Of The Designated Residence Residential Surveillance System

Criminal coercive measures are closely related with civil rights and areimportant to law reform. The new Criminal Procedure Law increased thedesignated residence residential surveillance system, causing widespreaddiscussion in the society.Designated residence residential surveillance is different from the otherfive criminal coercive measures, which has a unique function and value. Thecore of this article is to solve the problem of improving the system ofdesignated residence to residential surveillance through the reform of thesystem design, referring to the results of theoretical studies of foreignadvanced systems at home and abroad. Although the new Criminal ProcedureLaw and the latest Criminal Procedure Rules assigned residence residentialsurveillance with the new provisions, there are imperfections still in the system design and will encounter many new problems in the judicialpractices, it is necessary to carry out in-depth study and discussion of thesystem.This paper will focus on the scope of the application of “residence”, thetypes of applicable charges, problems of applicability and supervision.Finally, from the following five aspects, including relevant lawmaking, therefinement of legislation design, the build of procedure fairness, toinstitutionalize the specific ideas, wishing to contribute to the design of thesystem to be more scientific and rationalized, to make it more in line withcurrent national conditions, to play its due role in our criminal procedure. Thedesignated residence residential surveillance system’s improvement will notonly allow the criminal proceedings effectively protected, punish crimes andprotect the human rights and has important theoretical and practicalsignificance for the realization of people-oriented, building a harmonioussociety and building a socialist country ruled by law.
