Administrative investigation is a kind of administrative activity to gather information and find the truth,which is important for making correct administrative decision.In practice,the police administrative investigation has a bigger influence on civil rights compared with other government offices.Because of taking the responsibility of maintaining the public order,the police often use enforcement measures to intervene counterpart's personal and property rights,which is a big public power hazard to counterparts.The police administrative investigation is in stage of vigorous development and standardization.There are still some practical problems to solve,such as difficulty of accepting cases,non-standard in administrative investigation procedure,arbitrariness of administrative investigation and infringement of civil rights.Through making a unified administrative procedural law,establishing registration system in police accepting cases,improving administrative procedures,adoption of proportionality principle to regulate administrative investigation methods applying,improve law faith of police and perfecting the judicial review system of public security organs regarding administrative investigation,we can restrain and regulate the exercise of public security organs regarding administrative investigation powers,so as to protect the legitimate rights and interests of administrative counterpart.
