With the gradual improvement of China's market economy and the adjustment of national industrial policy,China's real estate industry has developed by leaps and bounds,at the same time,real estate intermediary industry gradually developed.Real estate intermediary industry is to provide information for the people to report information,provide media services,the main body of the market demand and supply of information between the formation of the link in the provision of convenient information platform to promote the real estate market circulation,there have been various All kinds of violations,the two sides even against the legitimate rights and interests of third parties,disrupt the market economic order.China 's real estate intermediary market development lag,confusion is the main reason for the imperfect legislation,the corresponding supporting regulatory mechanism is not perfect.The scholars of various disciplines have carried on the research to the real estate intermediary from the different angle,has many outstanding achievements one after another to come out,these theoretical achievements have provided the theory basis for our country real estate intermediary development.In this paper,the real estate intermediary industry highlights the irregularities listed to explore the behavior of real estate intermediary illegal forms,combing the legal relationship between the parties in the activities,in-depth study of various violations of the forms and background causes,comparative analysis of developed countries outside the country And China's Taiwan-related provisions of the system,to build China's real estate intermediary industry regulatory system put forward some suggestions.Hope that through their own issues related to the analysis and understanding,for China's real estate intermediary regulatory system to establish,make a little contribution.The first part expounds the basic theory of real estate intermediary service from the angle of jurisprudence,analyzes the legal character of real estate intermediary service and real estate intermediary contract in China,and briefly introduces the legal norms of real estate intermediary in China.The second part of the real estate market in China on the actual violations,analysis of various violations of the legitimate rights and interests of the parties involved,as well as the legal norms involved,outlined various violations of the social harm.The third part analyzes the reason and background of the real estate intermediary industry in China from three aspects: the exterior factor,the internal factor and the limit of our country legal regulation.Including the relevant laws and regulations,the level of development of the real estate industry and the overall economic situation of society.In the fourth part,based on the problems,causes and background of real estate intermediary industry in China,this paper attempts to put forward countermeasures to prevent and minimize the real estate intermediary system in China,Intermediary activities in the dispute,so that the real estate intermediary industry has become increasingly standardized and legal.
