Research On The Qualitative And Legal Protection Of The Live Broadcast Of Sports Events

In the recent years,along with our country people's living standards improve and the progress of science and technology level,the requirements of the spiritual and cultural life of people are also increasing.As part of the cultural life,sports events are paid more attention,times and opportunities that people watch sports events are more and more,it also promoted the rapid development of athletic sports industry.Legal problems resulted by it follows,legal disputes about sports live coverage is also increasing.However,in the theory and judicial practice,there is a big controversy about the qualitative and corresponding protection measures of live coverage.In this paper,through the study of representative cases in recent years,this paper analyzes the qualitative dispute between the current theoretical and practical circles on the sports live coverage events and its reasons,and puts forward the author 's view that "the sports live coverage should be characterized as video products".But because the law to the provisions of the relevant right of the law of our country is not advanced and perfect,to protect the infringed's strength in these cases is not very ideal.The infringement of the price of the infringer paid is too little,the judgment is questionable.When most of the court trail the legal disputes caused by sports live images,they always characterize the sports live coverage as “video products”,and use the “video recordings”related right or any other law to protect right holder,for example,“CCTV international partner v century dragon” trailed by Guangzhou intermediate people's court,“CCTV international partners v Chinese city” trailed by the court of Shenzhen futian district and so on.And some courts characterize the sports events live coverage as “work”,and do adjustment according to the law of relevant provisions of the copyright,for example,“sina v day surplus kyushu” trailed by the court of Beijing chaoyang district.Divergence about this problem is a problem demanding prompt solution,and we should also discuss how to qualitative the sports broadcast images and how to protect the holder of such problems.In the judicial practice,when the law is applied to deal with such cases,the author makes a way of combing and judging these methods,and puts forward their own suggestions to protect the sports live coverage by perfecting the relevant adjunct legal system.
