The live broadcasting industry of e-sports events develops rapidly under the promotion of Internet economy,and its economic benefits also induce various disputes in practice,among which the dispute about copyright issue is remarkable.The live video of e-sports events is different from the live video of online games and the live video of sports events,so we should pay attention to the distinction between the two when studying its copyright issues,and analyze it in combination with its own unique characteristics.The live video of e-sports events is formed on the basis of players’ operation of e-sports games,through the overall planning and shooting arrangement of the event organizer.For the live video of e-sports events with reproducibility and originality,it is appropriate to protect it as audio-visual works and the event organizer enjoys the copyright.Other subjects enjoy copyright in their respective rights.Among them,the copyright of the game pictures in the live broadcast belongs to the game developer because the game pictures of e-sports games are not original,and the game pictures can be protected as highly similar electronic works.In the process of live broadcasting,the live video of e-sports events will transmit other right objects at the same time.At this point,the spread of game images by the event organizer can constitute reasonable use,while the use of other right objects of works should be authorized by the right subject.Under the framework of the current copyright law,there is still a gap in the protection of live video of e-sports events in China.<The copyright law(submission of draft amendments for review)>has been partially improved,which should be affirmed,but there is still room for improvement and further responses should be made in light of the focus of disputes in judicial practice.
