The collective contract system established since 17th century in Britain,it creates a meaningful and harmonious social environment due to it is able to balance and stabiles labor relation and cushion labor conflicts.Because of this positive effects,it was implemented in most of countries all over the world.In 1950,collective contract system was established in trade union law of China as well.However,we had to be point out that the collective contract is not well governed by the present law in our country,the accountability and operability is not well constructed and organized in the entire system.unclear right ability that cause collective contract exist in practice has show the negative effect.Hence,collective contract system in our country does not fully achieved the desire goals as wish.Therefore in those area like protection of laborers' rights and interests and construction of a harmonious labor relations still has lots of room for improvement.The foundation of the collective contract is contract signing and implementation.In order to continue maximize the potential of the collective contract system,it has to improve the main body of the collective contract law,well define the rights and obligations,Regulate both parties behavior,enhance the ability of rights and behavior.Therefore,above statement is purely base on the perspective of subject of collective contract and analyze the problems from legislation and practice.by take reference from Germany,Japan,the United States as example and put forward Suggestions to perfect our country collective contract subject legal issues.
