"improper labor practices", also known as "unfair labour practices" refers to the both parties, labor users or labor unions use improper means, prevent or limit the other party or a third person to exercise their legitimate rights. Improper labor practices system, include both prohibitive norm against improper labor practices, and relief procedures to improper labor practices.The partys of improper labor practices, mainly includes labor users (employers), in a few cases, including labour unions.In the labour law, the legal system of improper labor practices is safeguards of right to form and join in the activity of a trade union in broad sense, as well as an important legal measures for criterion and balanced labour relations in the conditions of a market economy.As an important category of Labor law theory, the legal system of improper labor practices is an indispensable component of science of labor law under the conditions of the market economy system .Fundamentally speaking, the Constitution recognizes right to form and join in the activity of a trade union. The right to form and join in the activity of a trade union in narrow sense Only refers to the laboe's rights to form and join labor unions and to ensure independent functioning of the labor union.In broad sense it refers to the right of laborers use the force of organice to resistance the labour force users for safeguard its own interests. The thesis use right to form and join in the activity of a trade union in narrow sense. The basic content of the right to form and join in the activity of a trade union is that labors have rights to form labor union.Of course, form labor union is just means, the purpose of which is to enable labors to engage in collective bargaining with labor users and conclude collective contract.
