| The relatively concentrated administrative punishment is an important system established by the administrative punishment law of the People's Republic of China.The relatively concentrated administrative punishment is to repeat and cross the administrative power into one administrative organ.It not only simplify administrative structure and integrate law enforcement resources,but also avoid the duplicate law enforcement and repeated punishment.The relatively concentrated administrative punishment is the basis of comprehensive law enforcement,and the main content of comprehensive law enforcement is the application of the relatively concentrated administrative punishment.The field of urban management is the first to carry out the relatively concentrated administrative punishment into pushing the comprehensive law enforcement.On the basis of the comprehensive urban management enforcement,national scenic area system has also begun a pilot of the comprehensive law enforcement in order to solve the problems such as the diversity of law enforcement subjects and the lack of law enforcement authority in scenic area.S scenic area in Y city began to focus on the relatively concentrated administrative punishment as the main content of the comprehensive law enforcement pilot in 2015.Although some achievements have been made,some problems still exist.These problems restrict the use of the relatively concentrated administrative punishment in the comprehensive law enforcement in S scenic area.In this text,the transformation of government functions,system theory,good governance theory,combined with the concept of public management,based on the basic situation of the application of the relatively concentrated administrative punishment in the comprehensive law enforcement in S scenic area,the author objectively analyzes the achievements and analyzes the existing problems,such as over reliance on mandatory means of enforcement,inadequate organization,shortage of law enforcement officials,concentration of the scope of administrative punishment is too large,weakness of power supervision,the power of relatively concentrated administrative punishment has not yet issued place etc.According to the subjective and objective factors,the author analyzes the reasons for the above problems,including that the concept of law enforcement has not changed,the organizational construction is not standardized,the construction of law enforcement team lags behind,the standard of allocation of relatively centralized administrative penalty power is fuzzy,the power supervision system is not perfect and so on.And put forward the corresponding optimization countermeasures and suggestions according to the existing problems.Finally,on the basis 'of drawing lessons from Tai'an Taishan and Yibin Bamboo Sea scenic area on the experience of comprehensive law enforcement,the author puts forward on how to improve the use of the relatively concentrated administrative punishment in the comprehensive law enforcement in S scenic area,such as changing the concept of law enforcement,improving organizational structure,strengthen the team construction,setting up a scientific power of relatively concentrated administrative punishment scope,improving the power supervision system,the introduction of the provincial and municipal local regulations as soon as possible.Further promote the realization of the normalization and long term of management in accordance with the law,standard and order in S scenic area. |
