On Problems And Countermeasures Of Comprehensive Administrative Law Enforcement Reform At The Basic Level

Promoting the reform of the primary-level comprehensive administrative law enforcement governance system at the township(street)level is the request for deepening the reform of the administrative law enforcement system put forward in the Third Plenary Session of the Eighteenth Central Committee of the Party.Practice has proved that the key point and difficulty of deepening the reform of comprehensive administrative law enforcement are in towns and villages,and the starting point and weakness are also in towns and villages.The township(street)level,as the grassroots government,the promotion of its comprehensive administrative law enforcement is directly related to the realization of the overall goal of the rule of law government in China.In recent years,with the continuous deepening of the comprehensive administrative law enforcement reform,various models of system and mechanism reform are put forward in different areas.The more typical and representative ones are the model of “block-based,street-managed”,the model of “ tiered arrangements,co-management of district and streets”,and the model of “strip-based,direct management”.These three models have different characteristics in terms of law enforcement power distribution,operation methods,and efficiency advantages.At the same time,each shows its own shortcomings.At the level of laws and regulations,it is manifested as problems such as the unclear legal status of law enforcement subjects,the complex sources of law on which comprehensive administrative law enforcement is based,and the irregularity of law enforcement procedures;at the level of practical operation,it is characterized by unequal rights and responsibilities,unclear power boundaries,team construction,and the special law enforcement environments.In addition,due to the individualized reform programs adopted by localities according to their specific conditions,there are also challenges in the areas of integrity risks,various leadership,and insufficient territorial support.This dissertation sorts out three representative practical explorations in the reform of primary-level comprehensive administrative law enforcement in China,and makes a comparative analysis of these three models.Based on this,it proposes countermeasures to promote the reform of primary-level comprehensive administrative law enforcement.The first is to improve the standardized system of comprehensive administrative law enforcement,the second is to optimize the law enforcement system for comprehensive administrative law enforcement at the primary-level,and the third is to improve the team construction of comprehensive administrative law enforcement at the primary-level.
