Research On The Regulation System Of Net Private Equity Fundraising

As a new model of raising funds,network private donation is an indispensable component of chariy donation business in China,which plays an important role of solving life problems of special groups flexibly and efficiently.Although"Charity law"enacted in 2016 has provided key legal basis for chariy donation,attentions have been paid for lots of legal problems of network private donation,because of the lack of legal terms standardizing the network private donation.According to this background,the legal connotation of network private donation was analyzed and the differences of network private donation and seeking help personally were distinguished.The legal property of contract of benefiting the third partyt on network private donation was defined by way of explaining the network private law,moreover equity relationships between each object in the behavior of network private donation were analyzed systematically.Based on this,current legal issues of network private donation in China were explored,such as subject qualification,information disclosure and personal privacy protection,ownership of surplus property and so on.Also the deficiency of the legal specification for network private donation was pointed.This article proposed several measures such as improving the information disclosure system of network private donation,constructing residual property processing of agreement prioritizing,trying to return and trying to approximate,improving the civil rights protecting mechanism,building the exiting mechanism of public offer qualification and subject system of temporary raising.So that we can promote the healthy development of network private donation and provide reference for completing the civil law regulations of network private donation in China.
