Research On The Protection Of Human Organ Donors' Rights And Interests In China

Nowadays human organ transplant technology develops rapidly,providing more possible to extend patient's life,the protections of the legal rights for organ donors has aroused people's attention.The achievement of legislation and practice for human organs transplant in China are increasingly prominent,however,there still exists some deficiencies of regulations on human organ transplantation,such as restriction on subject qualification of organ donation.The uncertainty of legislation standard on death causing a series of consequences that organ donors cannot exercise their rights by their own will and organs donors have to inherit the invisible risks and hidden dangers without any compensation,even for lack of legal remedy when the right is infringed.In light of these issues that exist in reality,it is necessary to perfect our legislation,and to learn from foreign legislative experience.Determining the rights of human organ donors by the expressly state law,focusing on the protection of rights or interests and reasonable compensation for organ donors.They include right of informed consent,self-decision right,the right of life and health and privacy,etc.We should respect the personal dignity of organ donors,and put an end to trade in human organs,from the source,for protect the lawful rights of the selfless dedication of organ donors and provide strong legal support and legal relief when necessary.
