Research On Punitive Damages System For Infringement Of Intellectual Property Rights

The system of punitive damages against intellectual property rights is an important system in civil law of our country.China's current “trademark law”(revised 2013)sixty-third punitive damages in the first paragraph clearly stipulates the infringement of trademark rights,the provisions for the first time to fill the gaps in our system of punitive damages in intellectual property law,has milepost significance.However,in practice,there are still some problems to be solved in the application of the system.This paper will be discussed from the three aspects of the system of punitive damages for infringement of intellectual property rights,in the situation of our country,based on the successful experiences of other countries,by means of case study,in-depth study of the system of applicable conditions in the judicial practice,the applicable scope,compensation Jin Shi limit and other issues,to further enrich and improve the basic theory of punitive the compensation system of intellectual property rights in China.
