Research On The Basic Theory Of Chinese Marxist Modernization Of Law

This paper,taking China Marx School of law modernization(hereinafter referred to as the modernization of law)as the basic theoretical research,focuses on the process of socialist modernization,the developing direction of the modernization of law and the way of realization.According to the national character of our country,the development of law has always insisted on the guiding ideology of Marx's legal thought.Therefore,the author believes that the modernization of China's legal science is the modernization of China's Marx.The paper can be divided into four parts,which includes the meaning and characteristics of introduction and analysis of law modernization as the beginning.And then the author summarizes the development of western countries and China's Marx School of law.In the third part,the author directly puts forward the content and scope of legal modernization,and finally puts forward some ideas to perfect the construction contents of legal modernization.In the first part,the author introduces other scholars' understanding of the modernization of law,and then the author analyzes and studies the connotation and understanding of the modernization of law.And the connotation of the modernization of law is also analyzed at the same time.In order to make a further understanding of the modernization of law,the author compares it with other concepts,and summarizes the necessity and significance of its development.In the second part,through the collection and collation of the development process of Marx's theory of law,the author comes to its analysis and summary.First of all,the paper reviews the development process of the western Marx doctrine,and introduces the influence of Marx's law on the western mainstream law.Secondly,it analyzes the development course of Marx's jurisprudence in China and the achievements of the rule of law in every stage of development.Finally,based on the above analysis and summary,the law and characteristics of the development of Chinese and Western Marx's doctrine of law are obtained.The third part is the theoretical part,in which the author discusses the content and the scope of Chinese Marx School of law from the perspective of establishing the view of socialist law,enriching the leadership of the party and improving the socialist legal system.However,the reality is that there are many factors affecting the development of the modernization of law,just as that the author mentions that the legal awareness is not strong,the country is in a crucial stage of deepening reform and the impact of economic globalization,etc.In the fourth part,the author comes up with the ways to realize the modernization of law.On the one hand,We have to be clear with the four basic principles of the development of the modernization of law,namely,the principle of practice,the principle of seeking truth from facts,the principle of the party's leadership and the principle of the unity of the national character and the world.On the other hand,the author puts forward the specific ideas and thoughts on the three aspects of cultivating the consciousness of rule of law,developing the theoretical research,deepening the reform of the rule of law.Focusing on the modernization of law,the purpose aims to make its own contribution to development of Chinese theory of law.
