| By attracting social capital to participate in the construction of social public facilities,the PPP model not only reduces the government's financial pressure,but also introduces the skills of social capital,rich experience and advanced technology.PPP not only can reduce the cost of project construction and operation,but also improve service efficiency at the same time.But in practice,there are many problems in project financing,construction and operation.The financing link is the basis for the smooth implementation of the project,it is necessary to give priority to the problem,so the legal issues in project financing is particularly prominent.The existing legal norms level is low and not perfect,can not provide sufficient protection for the legal problems of PPP project financing,greatly restricting the use of PPP.The focus is on how to solve the legal problems in project financing in the existing legislation.Therefore,this paper will discuss the financing of government and social capital in this mode,analyze the form of government and social capital in PPP mode.The paper will focus on the government in the equity financing and social capital in the role of debt financing,analysis of the existence of the proper control of government control,the project risk sharing mechanism is imperfect,project public welfare and social capital profitability and other issues.Combined with the Ministry of Finance and the National Development and Reform Commission issued the relevant policy norms,the article proposed by strengthening the government's administrative supervision and agreement supervision,improve the project contract risk sharing mechanism,innovative sources of income and other ways to deal with the issues raised in the above.In order to promote the application and development of the PPP model based on the existing rules and regulations,and ensure the compliance and feasibility of the application of the model in practice. |
