On The Improvement Of China's Foreign Adoption Legislation

Foreign adoption has become a universal phenomenon with the development of globalization.However,due to political,cultural differences,the provisions of national laws in foreign-related legislation are different,adoption process inevitably leads to many legal conflicts.With the increasing number of foreign adoption,more and more countries are beginning to realize the importance of improving their domestic foreign-related legislation.However,in the process of foreign adoption in China,the domestic adoption regulations have been always applicable,which is very inconsistent with the reality.Even if some laws and regulations against foreign adoption,but also too general and simple.Foreign adoption and domestic adoption,although there are similarities,but there are also great differences.In the context of the increasingly frequent adoption of foreign countries in China,the current foreign-related legislation has been unable to meet some of the practical needs of our country due to the changes of the times,such as the unipolarity of foreign-related legislation.Therefore,China should speed up the pace of improving the relevant laws and regulations of foreign-related adoption,children's interests to protect as the most fundamental value orientation of foreign-related adoption legislation to promote inter-state foreign-related adoption work in a lawful and orderly manner.This paper analyzes the rules,procedures,postmortem supervision and legal application of foreign countries,including the provisions of foreign-related adoption legislation,and the comparative analysis and summary of China's foreign-related adoption legislation.In the analysis of China's foreign adoption process Based on the existence of various problems on the basis of China's foreign-related legislation to improve the development and make some suggestions.The improvement of foreign-related adoption legislation will be conducive to the stable development of foreign-related adoption order and also to protect the best interests of children.
