Research On The Review And Supervision System Of Normative Documents

Along with the process of China's rule of law, normative documents has become an important means of administrative implementation of administrative management,but because of the administrative organs of law thinking of the weak, the process is not standardized, resulting in a lot of illegal normative documents, a serious violation of the legitimate interests of the administrative counterpart. Therefore, in the process of comprehensively promoting the rule of law, strengthening the supervision and examination of normative documents is of great significance to promote the administration according to law and to build a government ruled by law.At present, China's regulations on the following normative documents examination and supervision is mainly for the record review, the authority of the judicial review of the record review of administrative organs and administrative reconsideration review, judicial supervision of the three supervision models. From the initial unsupervised to the establishment of today's review and supervision system, not only reflects the importance of normative documents, but also highlights the need for strict normative document review and supervision. Because of the lack of unified legislative norms and lack of supervision and examination in the practice of regulatory documents, a large number of inappropriate normative documents are not effectively supervised. Based on this, this paper selects normative documents as the research perspective. Through empirical analysis, comparative analysis of China's existing normative documents examination and supervision system, combined with the legislative, administrative and judicial practice, to improve the normative documents examination and supervision system, improve the effectiveness of supervision of the normative documents, ensure the lawful and reasonable.This paper starts from the connotation of normative documents, introduces the development of document review supervision and the value goal of our specification,in-depth analysis of existing problems of the current examination and supervision system, according to the current situation put forward to perfect the examination and supervision system suggestion. The value goal of normative document examination and supervision is to ensure the exercise of the right of administrative decision-making according to law, to ensure the normative documents, and to protect the rights of the administrative counterpart. Normative documents for a wide range of large, professional, examination and supervision institutions lack the ability to issue the examination and supervision procedures are not standardized, the standard is unclear and review the results of effectiveness is not strict, mainly should be at the national level unified legislation, strictly limit its competence, strengthen social supervision, strengthen the censorship ability, legitimacy and perfect rationality review, normative review procedures, improve the examination and treatment effect,strengthen accountability, and strengthen the examination and supervision of the normative documents.
