The Collection And Use Of Electronic Data In The Investigation Of Duty Crimes

With the development of science and technology,many kinds of equipment go deep into people's life,and have become the indispensable communication tool in people's life and work.Many kinds of electrical data have been produced because of the use of it.Those huge data which reflects people's life gradually be used for judicial investigation and sometimes has played a key role,especially in the investigation of duty crime.But the use of electrical data in judicial investigation is unskilled because of the use of it is a relatively new approach,whether in academic word or in juridical practice.The aim of this paper is make a contribution to the standardization of electrical data by analyzing of it in theory and in practice.First,this paper analysis the research situation of electronic evidence at present in academic,starting with the definition and mold of electrical data.Electrical data has been mainly defined as the data that stored in the computer and in the external medium in academic at present.But I think the definition is narrow with the development of science and technology.I think it should include all the paperless according to generation and storage of information,like analog signal,digital telephone,e-mail,recent call,note,voice band,and video and so on.So I think electronic evidence should be defined as all the material and their derivatives that in electronic form and can be used to prove the fact.Second,this paper above the electronic evidence has become an indispensable component in the types of our country combined with the use of electronic evidence in practice,especially in duty crime.At the same time,this paper introduces the present situation and existing problems of electronic evidence forensics in our country.Finally,this paper gives some suggestions of perfecting electronic evidence forensics of our country.Meanwhile this paper expounds some should stick to and pay attention matter in electronic evidence forensics and use of duty crime detection by summarizing work experience and the lesson in the practical.This including several principles that should be stick to when collecting electronic data,and several methods that can be used in electronic data collection,and some matter should be paid attentions in electronic data immobilization,and so on.
