Research On The Problems And Countermeasures Of Government Information Disclosure In China

Twenty-first Century is the era of information technology, the world’s information technology reform and development with each passing day, access to information has become very convenient, the explosion of information has also promoted the development of democracy. People have never felt more of the information and the changes it has brought like now. It has changed from being manipulated by the authorities to being out of control. People, all kinds of groups and organizations find the status of all walks of life and even detailed data from the vast information, so they can can guide life,production, or participate in social management more effectively.Government information is the most sought after one in all information. The demand for government information disclosure is also the most exuberant.Government information disclosure can effectively promote the transformation of government functions, improve administrative efficiency, strengthen democratic supervision, and promote the development of information society. Citizens must have the right so they can participate in public governance. Especially in our country, it has become an inevitable requirement for people be the masters of their own affairs. Since China promulgated and implemented the Regulation on the Disclosure of Government Information in april 2007 to now, the governments at all levels have made some achievements in the work of government information disclosure. But deficiencies are inevitable. Taking the information disclosure of Pukou district government of Nanjing as an example, I put forward a series of suggestions to improve it for related government reference, in this paper.While starting the study, I am responsible for the information release in Pukou District People’s Congress Office. So I have a certain understanding of the significance of government information disclosure. After in-depth discussion with the instructor, I found that this work is not only convenient for the public to obtain information,but also of great significance to the development of politics. However,it’s inadequate in law, government enforcement, judicial practice, supply security, etc,which means weak of foundation in China. Therefore, I use the theory of right to know, open government theory and political development theory to study and analyze the current situation of Chinese government information disclosure. Taking Pukou district as an example, I introduc the course of its development and the situation of 2015, so I can reveal its problems. Then I deduce following four main problems of Chinese government information disclosure: the mutual restriction between right to know and right of privacy, the entanglement between open government and open exceptions, the contradiction between the consciousness of confidentiality and open by application, and administrative litigation problems caused by imperfect law.Finally, this paper puts forward suggestions and countermeasures to improve the current situation of government information disclosure in our country based on the basic situation and four major problems. This paper argues that the deepest significance of government information disclosure is to promote China’s political development. Therefore, it is necessary to foster an environment that matches the current political climate. Then, contact the situation in Pukou, I put forward suggestions to improve the system of government information disclosure. Considering it takes long time to realize the above two pionts, while practical problems shuld being solved as soon as possible, I come up with some viable and rapid strateges in matter and the judiciary as a third suggestion.
