As a kind of non renewable natural resources of underground space,it is the use and exploitation of human beings with the history of human civilization and show different historical features and forms,until the modern society gradually formed a discipline and modern construction land relations.The industrial revolution led to the development of the underground space in various countries and regions in the world,which caused the development and modification of the relevant laws and regulations of the land.Developed countries（regions） on the underground space related laws and supporting policies have been quite perfect.At present,China is in a period of rapid development of urbanization,the development and utilization of underground space is huge,and the relevant laws and policies are lagging behind the needs of economic construction.It is of great practical significance to explore the legislation mode of underground space right which is suitable for China’s national conditions,and to improve the legislation and related system of underground space right is decided by the demand of the development of underground space in China at present.The main purpose of this paper is to provide effective legislative safeguards for the promotion of underground space right system in our country.This article is mainly divided into six parts to be discussed:the first part is the introduction.This paper mainly introduces the research summary,the significance of the topic,the research methods and framework of the underground space right.The second part is the basic theory of underground space right system.This part includes the concept and characteristic of underground space right,the legal relation of underground space right and the nature of underground space right.The third part is the comparative study of the legislation of underground space right.Through this part of the United Kingdom and the United States,Germany,Japan,and China Taiwan underground space rights legislation,comparative analysis and summary,on the basis of the underground space in other countries and regions on the legislative experience and the enlightenment to our country.The fourth part is the analysis of the existing problems in the legislation of underground space right.This part from the macro level and micro level to sort out the legislation of underground space right.The fifth part is the suggestion of the legislation construction of underground space right system in our country.First,put forward the guiding principle of our underground space rights legislation;secondly,the general concept of the underground space into property law,change the current legislation,the establishment of an independent chapter of the independent status of underground space right in property law;finally,from the underground space right legal relations,the main content,right relief put forward legislative suggestions on legislation of underground space right in several aspects.The sixth part is the conclusion.To sum up the key problems of the previous article,draw the conclusion that the legislation of underground space right,and further summarize the author’s suggestions on perfecting the legislation of underground space right in china.
