Research On The Legal Issues Of Administrative Protection Of Intangible Cultural Heritage

China is a heritage of thousands of years of civilization,which has been famous in the world for long historical and cultural foundation.2016 Spring Festival Gala broadcast,is to let Hua yin lao qiang the distinctive ethnic characteristics of the intangible cultural heritage has attracted much attention,caused us to think.At present,the theoretical research on the protection of intangible cultural heritage in our academic circles has achieved some results.The relationship between the public law and the private law protection of intangible cultural heritage has become the focus of the current theoretical research.From the point of the status quo of domestic and foreign research,I believe that:in view of the comprehensive analysis of the intangible cultural heritage' sactive state,comprehensive and inheritance characteristics,coupled with the urgency of some endangered intangible cultural heritage rescue,we should focus on improving the existing system of administrativeprotection,with the help of service-oriented government forces,to maximum saving the precious folk intangible cultural heritage in China.The promulgation and implementation of the Intangible Cultural Heritage Law has provided an important legal basis for the protection of intangible cultural heritage in the form of the Basic Law for the first time,and a large number of intangible cultural heritage such as Hua yin lao qiang has benefited from it.But the specific application to the practical,the law still exists the problem of strong macro principles but inadequate applicability,leading to the legal protection of Hua yin lao qiang is still faced with many problems such as few successors and less funds.In-depth analysis of the reasons can be seen,at present,the administrative protection of intangible cultural heritage of our country is still faced with problems of imperfect legislation;administrative confirmation work force weak and lack of perfect confirmation procedures;lack of professional management and management personnel;lack of standardized market operation system;administrative guidance and help system is imperfect and so on,all above reflect the problems of the application of the legal protection of intangible cultural heritage in our country.Therefore,I think that:learning the valuable experience from Japan,South Korea and other countries,we can take measures such as improve the applicability of the law;perfect investigation and filing system,refine the recognition procedures of the successor;improve the administrative licensing mechanism;set up specialized agencies and allocate specialized personnel;expand diversified way of administrative guidance and help;improve public participation and other solutions to further refine and supplement the existing system of administrative protection,finally to establish a systematic and standardized mechanism for the administrative protection of intangible cultural heritage.
