Legal Research On Community Drug Abuse

Drugs have been brought to our country great shame and damage,the opium trade in the late qing dynasty without causing depression and defeat the southeast coastal area of our country's industry and commerce,and more are destroying the nation's physical and mental health,brought great damage to the national spirit and the flesh.Mind thick plot the opium war,our view of drug addicts tend to be biased,the drug addicts treated as marginalized groups,labeled as "bad guys",on most of drug taking punitive measures,no recognition of drug addicts,as a special "patient"identity,from the perspective of care to include drug addicts,not actively carry out rehabilitation measures to help drug addicts withdrawal addiction,which in turn brings to the successful return to society addicts.Detoxification system in our country,the long-term for compulsory drug addiction rehabilitation,receive punitive measures such as monopoly.The drug laws of the People's Republic of China(hereinafter referred to as the anti-drug law)and the detoxification ordinance in June 1,2008 and June 26,2011,marked the detoxification system in our country to build a complete,formally established a voluntary drug rehabilitation,community rehabilitation,compulsory isolation detoxification,community rehabilitation "four one" drug rehabilitation treatment system.Among them,the community rehabilitation as a new rehabilitation measures,adhere to the people-centered principle,to guide and help drug addiction researchers to establish new values and behavior norms,help them to accept the social dominant value and behavior standards,return to society.But in the old because of the rule of law concept,part of the system and measures is not sound,lack,lead to the value goal of community rehabilitation cannot reach.Presented in this paper,according to "the analysis problem a problem solving"thinking framework,to analysis of community rehabilitation related legal issues.The full text is divided into four parts:the first part of introduction,mainly introduces the research selected topic background and the selected topic significance,the research status at home and abroad,research methods;The second part mainly introduces the related concepts,characteristics,community rehabilitation the basic content of legal system and the significance of community rehabilitation,and community rehabilitation with the similarities and differences among the other three rehabilitation measures;The third part lists three has certain typical domestic cities perform community rehabilitation concrete model,for the author to collect some of the national or local analyze empirical data,points out that the legal problems of community rehabilitation and formation reasons;The fourth part mainly put forward the legal countermeasures of perfecting our country's community rehabilitation work,including to renew the idea of rule of law,establish and improve the system,the implementation of supporting measures and so on three aspects of content.Due to the community rehabilitation is a systematic project,has a certain complexity.This article discussed from two aspects:legal and execution,reflect on legal problems of community rehabilitation in our country,and puts forward improving Suggestions.
