Research On The Selection System Of Bankruptcy Administrators

The enterprise bankruptcy law in our country for the first time in 2006 introduced the world popular enterprise bankruptcy administrator system,establish a bankruptcy administrator center doctrine replaced the original much-maligned liquidation group, it makes our enterprise bankruptcy law keep pace with the market economy.But the enterprise bankruptcy law has congenital defects the social background and influences the exertion of the judicial function. The limitations of bankruptcy administrator system is more and more highlighted as the reform of market economy innovation in our country, that seriously affects the transformation and upgrading of the market economy reform. So, it has become the top priority which perfect the system of enterprise bankruptcy administrator. The purpose of this paper is to set out to the first step of enterprise bankruptcy administrator system ---the selected system ---to analyze the defects of the system design and the problems in practice, in order to put forward relevant solutions, and help to perfect the system of bankruptcy administrator in our country.This paper will be divided into four parts except preface and conclusion, the main contents are as follows:The first part is about the overview of bankruptcy administrator system,preliminary analyze the concept and characteristics of the bankruptcy administrator system,the connotation of bankruptcy administrator selection system, and the development history of the bankruptcy system in our country. The second part emphatically set out from three countries whose bankruptcy administrator system is more perfect and representing the three elections of the bankruptcy administrator system---the United States, France, Germany, to inspect selection system design of the bankruptcy administrator. The third part mainly discuss the present situation and problems of bankruptcy administrator selection system in China about the selective subject, how to select the bankrupt administrator and the qualification admittance.The fourth part mainly put forward some perfecting suggestions on the legislative and judicial which in allusion to the problems in the third part. Mainly including the build of double-track, increase temporary bankruptcy administrator system, scientific managers list, improving the process design, expanding the use of competitive selection,setting the unified exam,and guiding the personal manager to play a role step by step.
