A Comparative Study Of Intellectual Property Protection Provisions In WTO And TPP

The development of the economic globalization makes the protection of intellectual property rights more and more accounted all over the world,which promote increasing the level of intellectual property rights protection.The World Trade Organization(WTO)has brought the intellectual property rights protection into the trade system for more than ten years by "agreement on Trade-Related Aspects of Intellectual Property Rights"(TRIPs).The TRIPs agreement established the protection system of intellectual property rights with high standard,which meets the interests of developed countries in some extent.However,the United States and other developed countries are not very satisfied with the TRIPs agreement.After the Doha Round failure,the United States announced to join the "Trans-Pacific Partnership Agreement"(TPP)and tried to bypass the WTO to set up new protection system of intellectual property rights in 2009.Although Trump announced they will withdrawal from the TPP agreement after he came into power,but the intellectual property rights protection clauses of the chapter 18 in this agreement still have reveived high attention from all over the world,which promote the international protection standard of intellectual property rights to a new height.Firstly,from the perspective of intellectual property rights,we discussed the background and significance of this subject.Then,we sorted out the research status in domestic and overseas of the intellectual property rights protection in TRIPs and TPP.Secondly,the definition and characteristics of intellectual property rights was discussed and the relationship between the intellectual property rights protection and international trade was analyzed.Thirdly,the background,characteristics and basic content of the TRIPs and the TPP were expounded.Fourthly,the comparative study was carried on the protection clause of intellectual property rights of the TRIPs and the TPP.Finally,this paper expounded the enlightenment of the development of Chinese intellectual property law system.At the same time,put forward the coping strategies when China facing the high standards of intellectual property protection.
