In the course of social development in the radicals are mainstream,the qualification has its own advantages in restricting or depriving criminals of recidivism.We carry out the following research on qualification:The basic concept of qualification penalty,the provisions of the qualification of foreign countries,the status of the development of China' qualification penalty,the qualification penalty to improve.The paper consists of five parts,totaling about 15,000 words.First chapter: Introduction.This part mainly discusses the purpose and relevance of the study of qualification punishment,the current research status.The second chapter: the basic theory of qualification penalty.This part first studies the connotation of the study qualification penalty.By comparing the viewpoints of different scholars,we think the qualification penalty is deprived of content of the criminal.Analyzes the characteristics of the qualification penalty,understand the origin and evolution of the qualification penalty,and finally analyzes of the qualification penalty.The third chapter: Legal Provisions on Qualification in Foreign Countries.This part introduces the classification of foreign qualification system systematically,and then introduces the viewpoints of German and French qualification punishment system and the study place which is beneficial to our country.The fourth chapter: the present situation and reflection of the legislation of qualification punishment in our country.This paper introduces the deprivation of political rights and expulsion from the existing laws of our country,introduces the quasi-qualification rules outside China 's penalty system,and then analyzes the problems and reflections of the existence of the qualification penalty in our country.The fifth chapter is the legislation of qualification punishment in our country.Mainly from two aspects to make up,that is,to improve their own system of qualifications and improve the application of qualified punishment system.
