At present,the third party involved in marriage occurs frequently,marriage was been damaged.Throughout the world,most countries have relevant laws against the third party,but our country lacks corresponding laws and regulations,the interests of the injured party can not be protected,and it is not conducive to family harmony and social stability.Therefore,it is very important for our country to establish laws to trace accountability of the third party.This paper will be divided into four parts.The first part,I first definite the concept of the third party and the performance of a third party step in marriage.Then analysis the property of the third party step in marriage.Last coming to the conclusion that the third party violated the spouse rights.Second part,analysis our country's legislative circumstances and problems of the third party step in marriage.Third part,studying the common law countries' relevant legislation of spouse rights and third party step in marriage.The last part of the article,combine common law countries' relevant legislation of spouse rights and our country's legislative circumstances,put forward legislative proposals for our country to trace accountability of the third party.Hope it can maximize the compensation of innocent party during the practice.
