Research On The Legality Review Of Major Administrative Decisions

The review of the legitimacy of major administrative decision-making is an indispensable part of the rule of law.This paper analyzes the content and requirements of the administrative decision-making legitimacy review by taking the administrative decision-making of the motor vehicle as an example.At present,China's major administrative decision-making legitimacy review system is not very perfect,is still very weak.The Fourth Plenary Session of the Eighth Central Committee of the Communist Party of China(CPC)pointed out that it was necessary to establish a review mechanism for the legitimacy of major decision-making within the administrative organs and to establish a system of accountability for life-long responsibility and a system of accountability review.It shows that the national level attaches great importance to the question of the legitimacy of major administrative decision-making.Based on the existing research on the legitimacy of the major administrative decision-making,this paper discusses the relevant concepts of administrative decision-making,and then discusses the "major" of the major administrative decision,and studies the content of the review of the legitimacy of the major administrative decision-making This paper analyzes the contents of the legitimacy of major administrative decision-making,analyzes the reasons of the legitimacy of the major administrative decision-making from the values of legitimacy,democratic theory and justice.Thirdly,the paper analyzes the implementation situation and the related problems of the review of the legitimacy of major administrative decisionmaking in reality,combining with relevant cases and normative documents.Finally,on the basis of this analysis and induction,the author puts forward the corresponding suggestions on the specific factors such as the subject,scope,review standard,review procedure and accountability mechanism of the major administrative decision-making legitimacy review.
