On The Distinction Between Theft And Fraud

The distinction of the crime of theft and fraud has always been a controversial focus in criminal law.Although in theory,this topic has been discussed for a long time,but in the judicial practice,because of the progress of science and technology and the diversification of trading,many cases of criminal means has started touching the fuzzy zone of two crimes,fraud and theft is seemingly,differences between the traditional theory applied on the two crimes are sometimes difficult to define.So it has brought great difficulties for the qualitative study of two crimes.Therefore,it is an important task for the theorists to seek a breakthrough in the theoretical circle through the analysis of the typical two cases.This paper will regard the currently popular two-dimensional code case as the basis to distinguish the crime of theft and fraud,as well as the standard of distinguishing the meaning of special cases are discussed simply,hoping to distinguish the crime of theft and fraud and put forward some theoretical methods and meaningful research direction.
