Research On The Evaluation Of The Implementation Effect Of The Regulations On The Protection Of Intangible Cultural Heritage In Guizhou Province

Along with the informationization,the acceleration of urbanization,industrialization and modernization development,a large number of rare and precious intangible cultural heritage suffered varying degrees of damage or loss of human natural environment and the original cultural ecological environment has also been greatly affected and destroyed.The party put forward in the fourth Plenary Session of the 18 th CPC Central Committee to comprehensively promote the rule of law,building a socialist country under the rule of law in our country comprehensively promote the rule of law process under the background of the times,for the legal protection in the protection of intangible cultural heritage,is to promote the practical needs of the construction of rule of law,but also conform to the trend of the era of the rule of law in contemporary society.In June 1,2011,the implementation of the intangible cultural heritage law of People's Republic of China marked the beginning of a new era in the field of administrative law protection.In March 30,2012,the Guizhou Provincial People's Congress promulgated the "Regulations on the protection of" non material cultural heritage in Guizhou Province,the official implementation between the local legislation and central legislation,protection and inheritance of Guizhou local cultural heritage project since then have a clear practical basis and legislative protection.The evaluation of the effect of the implementation of laws andregulations is an important measure to ensure the gradual strengthening of the rule of law in China,and to improve the quality and efficiency of legislation.Effect assessment of the implementation of laws and regulations in our country as a system began in 2004 the State Council issued the "National Program" to promote administration according to law(the 2004 Document No.10),in 2008 the newly revised "working rules" the State Council administrative rules and regulations must be carried out after the assessment of legislation,the construction of the government under the rule of law enforcement outline of the State Council on 2015 the issuance of the "(2015-2020)" again should regularly carry out the laws and regulations of evaluation after legislation,improving the government scientific legislation.This paper selects the Congjiang County as the research point of empirical investigation,the effectiveness and shortcomings of the "Guizhou province Intangible Cultural Heritage Protection Ordinance" has been promulgated and implemented in the analysis of the value judgment and the qualitative and quantitative,through the theory and data analysis of the status of implementation of "intangible cultural heritage protection Ordinance" after the enactment of Guizhou Province,to provide the feasible and effective legal guarantee mechanism for the protection and development of intangible cultural heritage in Guizhou Province,so as to ensure the development of native cultural integrity ofthe living environment and the protection of intangible cultural heritage,promote minority legal culture construction.This paper is divided into four parts,the structure is as follows:The first chapter introduces the basic situation of the evaluation of intangible cultural heritage protection in Guizhou Province,including the purpose,scope,methods and methods of evaluation.The second chapter is the analysis of "Guizhou province Intangible Cultural Heritage Protection Ordinance" legislative overview and evaluation.The third chapter is on the guizhou province non-material cultural heritage protection ordinance implementation effect evaluation of data collection and analysis,including the implementation of the regulations of the main achievements and the existing main problems.This paper puts forward the evaluation conclusion,and puts forward some Suggestions for the problems existing in the implementation of the regulations.
