The Nature Of The Transaction Behavior Of The Construction Project Department And The Attribution Of Responsibility

This paper studies transaction behaviors of the department of construction project.Except introduction and conclusion parts,this paper includes other four parts.The first part investigates disputes over transaction behaviors of the department of construction project.It carries out statistical analysis about relevant cases of local court on basis on judicial statistics.In addition,this part summarizes judging methods applied to settlement of disputes over transaction behaviors of the department of construction project,including liability of contractors under apparent agency or job duties,and liability of constrictors or joint liability of contracts and constructors in fuzzy state.The second part interprets three major judging methods applied to disputes over transaction behaviors of the department of construction project.Moreover,this part conducts in-depth analysis about apparent agency,job duties,and joint liability.In addition to analysis about their advantages and disadvantages,this part also finds out main problems of current judging methods.The third part analyzes the department of construction project and its transaction behaviors,so as to clarify concept of the construction project department and duty scope of the construction project.It defines transaction behaviors of the construction project department on such basis.This part elaborates on the influence of illegal sub-contracting,illegal contracting assignment,affiliated operation,and other illegal acts on transaction behaviors of the construction project department.First,these acts cut down links between the construction project department.Second,they increase uncertainties of traditional apparent agency and duty behaviors.The fourth part comes up with plans for settlement of these problems.By illustration of necessity of apparent agency,appropriateness of joint liability,and complementary liability of constructors,this part suggests establishing a system for transaction behaviors of the construction project department,which takes joint liability under apparent agency as the subject and individual liability of constructors as the complement under the influence of illegal sub-contracting,illegal contracting assignment,affiliated operation,and other illegal acts.
