In recent years,with the quick development of the industrialization and the urbanization in our country,employment growth is accelerating,which makes the two sides sign a labor contract for the rights and obligations of the parties.The labor contract gradually become the main form of contract in the social life.With the economic downturn,the contradiction between the laborer and the employing unit is becoming increasingly prominent;labor dispute cases continue to rise;and the termination of the labor contract has been gradually normalized and universal.In order to protect the basic rights and interests of workers and employers,the labor contract law provides for the termination of the labor contract.The lifting of the labor contract involves the concept,content,procedure,legal liability and other aspects of the legal issues.On the basis of clarifying the relevant legal concepts of labor contract,this article analyzes the legal issues involved in the lifting of the labor contract,and from the legislative,administrative law enforcement,judicial,law-abiding and so on,this paper proposes a fair,open,actionable legal conditions and procedures for the lifting of labor contract.This can not only reduce labor disputes,contribute to the harmonious labor relations,but also can promote the healthy flow of talent,promote the development of market economy,maintaining social stability.
