Research On Personal Data Protection Issues In EU Law

As the birthplace of personal data protection,the European Union formed a complete legal system of personal data protection,and the Directive 95/46/EC is the core of it.In addition to the defination of personal data,the EU has formed the right system with right of access by the data subject?right to be forgotten?and right to data portability and so on,along with the the promulgation of the Regulation.Because of its continuous development of the international markets,cross-border personal data has gradually become the forcus of the EU legislation.As far as the EU concerned,it is based on the provision of "adequate protection" by third countries as a fundamental principle for the protection of cross-bored personal data.However,the countries which can achieve the standard are not much,in order to promote the flowing of cross-border data,the EU pushes out the standard contract,the BCR rules and so on as supplement.In addition,EU is also actively engaged in bilateral cooperation with other countries,such as the United States,they signed the "safe harbor agreement","umbrella data agreement" and "privacy shield agreement" and so on.The data protection is without borders,both China and the EU should strengthen international cooperation to address the contradictions between the current regulatory oversight in each country'own region and cross-region data protection.
