In an era of economic globalization,attracting foreign investment has been a major target for modern countries.Therefore,one of the researching point in the field of International Investment Law is how to provide a fair and effective dispute settlement system for investor-state controversies,how to hit a balance between the interests of foreign investors and host states,etc.In terms of aforementioned circumstances,as the main method for host states to interfere foreign investment activities,indirect expropriation has been,and will continue to be a focus issue in this field.On one hand,it is a long-term principle of traditional international rules and legal practices that countries has the legitimate sovereign power to pose indirect expropriation on foreign properties.On the other hand,along with the furtherance of economic integration,countries have began to structure bilateral investment treaties and regional investment treaties for the security of foreign investment activities therein.This article will focus on the definition of indirect expropriation and its manifestation as well as specific types in practical terms,combining the development of international investment treaties and investment arbitration practices,and try to analyze the haunting conflicts on indirect expropriation definition and its identification criteria,aiming at figuring out the future development of indirect expropriation in both national and international levels.
