Research On Legal Issues Of Data Transactions

With the large data technology innovation,large data applications are also constantly expanding,from the initial business areas extended to the public service areas,medical fields,the value of large data increasingly social subjects and even the country's attention.In this context,large data industry,but also to the rapid development.Large data transactions as a large data industry,is a measure of large data industry development of the main criteria,but also to achieve the key value of large data.At present,there is no uniform legislation on the relevant norms of large data transactions,but scattered in the local government regulations,and the provisions of the more principles.The status of large data transaction legislation,leading to large data transactions,although there are many problems,but difficult to effectively solve,seriously hampered the development of large data industry.The first chapter of this paper is a basic overview of large data transactions.This chapter first defines the connotation of large data,compares the large data with similar data and information,analyzes the difference between the big data and the difference between the two,and expounds the value of the big data.Secondly,this chapter discusses the basic contents of large data transactions,including the concept of large data transactions,the background of large data transactions,the legal relationship of large data transactions and the way of large data transactions.The second chapter of this paper makes a comparative analysis of the current situation of large data transactions between China and the United States.This paper analyzes the current situation of large data transactions between China and the United States in four aspects,such as large data transaction type,large data source,large data transaction status and large data legislation,and makes a detailed analysis on the status of large data transaction between the two countries.The third chapter of this paper mainly discusses the problems in the big data transaction,including the legal system level and the problems in the practice of large data transaction.The problems of the legal system include: the large data property rights are unknown,the main account of large data transactions is unclear,the sensitive data cleaning rules are not perfect,the data transaction scope is not clear and the large data transaction supervision is imperfect.Problems in large data transaction practice includethree aspects: large data market mechanism problem,large data transaction monopoly problem and illegal large data transaction.The fourth chapter is to solve the problems in the large data transaction.The solution to the legal level is divided into: clarifying the ownership of large data,clarifying the main responsibility of large data transaction,improving the rules of sensitive data cleaning,defining the scope of data transaction and perfecting the supervision mechanism of large data transaction.The solution of the practical level of the problem: the opening of large data personal trading market and the establishment of large data secondary market,the right of large data rights to limit and regulate the illegal large data transactions.
