Legislation is the foundation of China.Laws and regulations has very close relation with the long term stability of society also can well protect people's right.In China,the administration legislation is an important part of legislation and play a key role in the development of economic and society.To improve administration legislation also will promote China law and regulation system toward perfect.With the development of society and politics,a fair,open and publicinvolved legislation already becomes a critical part of law-making procedure.China continuously enacts lot of laws and regulations these years such as Legislation Law of the People's Republic of China,Regulations for the formulation of administrative regulations,Regulations for rulemaking procedure,etc.All these give impetus to the social progress and democratic development.Provinces and cities also carry out practice of public participate legislation which becomes a tendency to establish law in scientific way.People can know better of administrative legislation and be a member to join the process of making administrative regulations through conference,discussion meeting,etc.All these action has great significance to achieve people's right of participant and plays a vital role in promoting the rationally,impartially and scientifically of legislation.In the meanwhile it insures that China can achieve the goal to establish a good law.With the rapid development of society,people's enthusiasm and practice to join the legislation grows fast as well.But we need to point out it can't completely adapt the process of scientific legislation.We need to face a lot problems for example public participate is still in small number;no specific low can guide public to join legislation;public advice can't be adopted effectively;the right of join administrative legislation can't be guaranteed.All these problem lead to the reality that people-involved administrative legislation is just an empty rule and it can't play a critical role in building the scientific legislation system.Based on above consideration and China condition,writer suggests summarize and learn from foreign experience and improve the process of public-involved administrative legislation such as administrative legislation disclosure system,public motion system,public hearing system,participation rights guarantee system and so on.All these methods will greatly promote our country scientific legislation process.
