Thoughts On Perfecting The Adult Guardianship System In China

"The Research Report of China Employee Pension Reserve Index 2015" shows that China's population aging has been more serious,is expected to China's population over the age of 60,by 2020 will reach 248 million,by 2025 will reach 300 million,will be close to the depth of the aging society.The growing trend of aging has also become a serious issue facing the world.With the deepening of the degree of social aging,China's current laws on the provisions of adult guardianship system can not meet the needs of the development of the times.The published provisions of the General Principles of Civil Law concerning adult custody have been significantly different from those of the previous system,but there are still obvious shortcomings.In the process of revising and perfecting the adult guardianship system,our country should extensively study and draw lessons from the experience and achievements of the legislation in the world,and take its essence as the modern adult guardianship system which adapts to the modern human rights protection concept and conforms to our national conditions.In the 1990 s,the neighboring country Japan,like our country at the present stage,had the problem of population aging.In the face of all kinds of social contradictions and legislation lag,Japan decisively carried out adult supervision legislation reform.This reform results set the essence of adult guardianship system in western developed countries,worthy of our reference.Based on the above-mentioned problem consciousness,this paper mainly adopts the method of system comparison and sociology analysis,which is divided into four parts besides the introduction and conclusion.The first chapter focuses on the analysis of the defects of the existing adult guardianship system in our country.The second is the analysis of the current situation of the adult guardianship system in China.The third chapter introduces the basic theory of the adult guardianship system,including the concept,the nature and the meaning of the system.The forth chapter puts forward some suggestions on perfecting the adult guardianship system in our country,expecting our legislation to take the long term of our country,and make the study of our country's adult guardianship system,to build a set of in line with China's national needs of the adult guardianship system.
