The industry of financial lease has been introduced into China for more than 30years.However,its growth is far away from what we have expected.One of the most possible reasons is that the legislation on regulating the industry has been far behind the development of it.Another more fundamental factor is that the academic research on legislation on financial lease is far from enough,especially from the perspective of systematic legislation.Given what is said above,this essay will analyze the essence of the legal relation of financial lease,the transaction model and the range of objects of financial lease and the difference of“????”and“????”in China's legal system and put forward the author's own opinion.Then this essay introduces the legal system of financial leasing of China and points out the problems found in the system.Then with the comparing with the legislation of other countries and international organization,this essay analyzing the internal systemaltization of the law of financial leasing on the basis of the draft of The Law of Financial Leasing of China and makes some available advice.Then,this essay puts forward a project about the external systemaltization of the law of financial leasing of PRC combined with compiling the code of civil law of PRC and the characteristics of the existing system of the law on financial leasing.
