Research On The Legal Issues Of Forest Rights Registration In China

The concern of forest property is due to the realistic demand for the use and benefit of forest resources.However,there are many shortcomings in our policy and current legislation,and the registration system is one of them.Forestry property registration refers to the national forestry authority on application by the right holder,the applicant arising from the exploitation of forestry resources according to law rights and issues of real right alteration in the forest right on the registration in the register of the fact.Under the premise of real estate registration uniform and perfect the forestry rights registration system is imperative.Forest is discussed in detail in this paper the object of the registration system,nature and development of forestry property registration against existing legislation,forest registers as well as type and other major issues of the in-depth analysis and cropland has been controversial for a more detailed analysis.Meanwhile,solutions put forward their views on various issues.Forestry property registration is an important part of forest property right system of our country,can serve to protect the rights of forest,reducing forest rights dispute,achieve the efficient use of forest resources and promote sound development of forestry economy and other important roles.This paper consists of five parts,The first part is the problem statement,registration law by combing the forest in China,after a comprehensive understanding of existing laws and regulations,problems found,and are discussed later.The second part discusses China's forestry property registration system,the object of in-depth analysis of forestry property rights registration,including forests,woodlands,forests and forest resources;Next combed the forest rights registration history,finally puts forward his own views on the nature of forestry property registration.In the third part,registration of forest legislation,because of the promulgation of the interim regulations on registration of real estate,in large part to solve the original problem of inadequate legislation,but registration is still in the forest there are some problems,we select two issues to be addressed the recommendations of analysis,the first is the legal level of the lower,and the second is cropland should be registered.Cropland is registered as the paper's original ideas.The fourth part is about the problems existing in the practice of registration of forest rights.This article only chooses two directions to analyze and make suggestions.The first is the most important forest registration register,the second is the type of forest registration,this article holds a positive view of the need for registration of the notice.The fifth part is about the legal issues related to registration of forest rights.
