The research on the public policy of our country state-owned land on the housing levy in other countries and regions on the general theory,experience the city housing levy,combi ned with the actual economic and social development in China,through the full comparison and analysis,summarizes the emergence of Countermeasures of house expropriation and compensation of state-owned land i n our country is on the stage strong practical significance.This paper starts from the legislative purpose,accurate grasp of the legislative and theoretical meani ng of the text,on the basis of the standard of expropriation compensation in practice by evaluation,analyzes the rationality and existing problems;fi nally,put forward Qingdao city housing levy compensation proposals.In view of the many problems involved in the government's urban housing levy,one by one analysis and put forward countermeasures and suggestions is the main theoretical innovation.In content,this paper through the research on some problems of Qingdao city housing levy compensation,puts forward some countermeasures and suggestions about the city housi ng levy compensation in turn from the defi nition of public interest,public information collection,evaluation,hearing procedures,compensation standards in five aspects,to further standardize the collection behavior,explores ways to improve the standard of compensation for expropriation.Abstract in view of the concept of public interest and legal uncerta inty,the author put forward the preliminary design ideas determine the public interests,which adhere to the procedural and substantive standard standard,i n the procedural due process standards,design before the collection i n the hearing etc;substantive standards,to follow the principle of proportionality,the principle of majority to consideration of the public interest exists,and supplemented to guarantee j udicial review procedure.According to the present situation of information disclosure provisions is not perfect,enrich and perfect the public should put forward from matters,establish full supervision to promote the work of the housing levy system,information management,and actively accept social supervision of the four aspects of i mproving the collection of information disclosure system.In view of the narrow scope of the application of the hearing,it is suggested that the hearing procedure should be i mproved from two aspects: the establishment of the pre hearing system and the collection of the hearing procedure.According to the housi ng assessment formality phenomenon,suggestions from the establishment of assessment agencies access mechanism,a reasonable grasp of evaluation principles,evaluation institution selection and evaluation process,standardized and transparent relief procedure in the four aspects of i mproving the collection and evaluation system;fi nally,the problem of the key problems in the housi ng levy the contradiction that the compensation standard,put forward the i mproveme nt of housing compensation standards the lessee to give fair compensation,enrich and perfect the standard system of non residential housi ng compensation,i mprove the standard of compensation for expropriation,compensation standard system to establish a fair and reasonable compensation to resolve disputes of the fundamental way.
