On The Commitment Of Minors' Tort Liability

In recent years,the beh avior of juvenile tort in China is be coming more and more serious,which has affected social harmony and stability to a certain ex tent.Moreover,due to the particularity of our country' s history,culture and national conditions,the current civil laws concerning the tort liability of minors are quite different from those in the continental law system and the comm on law countries.China's current tort liability law,because in the p rovision of m inors infringement,its guard ian to assum e full responsibility,has been widely disputed by experts at home and abroad.In view of these disputes,I have carried on some research to the minor's tort responsibility system.The introduction of this study,starting with a classic case of juvenile tort,describes the course of the case and the p ublic controversy.The first part gives a brief introduction to the m ain legal terms in the st udy of the subject of the tort liability of minors,and makes a detailed study of the fo reign and domestic research results.The second part introduces the relevant provisions of Ger many and China on m inors' tort liability in terms of age,and makes a brief analysis.The third part of our country on minors tort liability legislation,elaborated some of its own recommendations.
