Intellectual Property Protection Of Chinese Herbal Medicine

Chinese herbal medicine has a long history in China.Since ancient times,it has formed a unique theoretical system.It is the Chinese nation in the world's human health picture book rich and heavy color,but also the wisdom and heart of the people of our country.As the source and resource power of Chinese herbal medicine,we have a unique geographical advantage,a vast literature ancient book,a variety of Chinese herbal medicines and unique therapeutic effects.But in recent years,because of the difficulties in the development of technology,a large number of Chinese herbal medicines are difficult to get the protection of intellectual property.Many Chinese herbs have been registered first step by the other countries in the world,and then they have been sold in a large number of markets in our country and have obtained high profits.Therefore,it is urgent to protect our national treasure Chinese herbal medicine effectively by means of intellectual property rights.This paper begins with the introduction of the meaning and characteristics of Chinese herbal medicine and the legislative situation of the protection of Chinese herbal medicine in various countries.Then it expounds the present situation of the intellectual property rights of Chinese herbal medicines at present,and analyses the reasons for the lack of legislation of Chinese herbal medicine.Finally,some suggestions for the protection of Chinese herbal resources are put forward through the study of these related problems.I hope that through this article,we can fully mobilize the positive forces at all levels of the society and join the team to protect Chinese herbal medicine,so as to be of benefit to the research on the protection of intellectual property rights of Chinese herbal medicine.
