With the advancement of science and technology,the pace of social development has been accelerating,and payment methods used in transactions have gradually increased.In particular,online payment methods are widely used because of their convenience.However,there are also problems such as excessive links and poor security.Against this background,the frequent use of telecommunication networks to infringe on property-related cases has led to cases where theft and fraud are intertwined,in particular it is difficult to distinguish them with traditional theories,making the case more complex and difficult to determine.Theft and fraud have always been the focus of academic discussion,and they are also the most frequent cases in practice.There has been a lot of controversy over the distinction between two crimes,but with the advent of telecommunications networks,the distinction between two crimes has become more complicated.This article focuses on objective elements,disposition and combines classical cases in judicial practice.It studies the cases of infringement of property using telecommunication networks and draws an effective method for distinguishing between theft and fraud.It hopes to be effective against both crimes.Hope to make some constructive suggestions.
