The Criminal Law System Of Online Rumors

In recent years,with the continuous development of network and information technology,network space has become another important space for people to carry out various activities,because of its huge information coverage and speed of transmission,and the wide dissemination of regions.But at the same time,the Internet as the platform for the rumor of the behavior is also growing,showing a state of high incidence.The behavior of network rumor not only affects the healthy and orderly network environment,but also seriously threatens the daily life of the citizens,which is very destructive.The criminal law amendment(nine)has made up the crime of spreading false information by adding second of the 291 st articles.It has formally incorporated the Internet rumors into the scope of the criminal law,and further strengthened and perfected the legal provisions for the Internet rumors.However,in China's criminal law,there are still some problems in the regulation of network rumor,such as too little punishment and low maneuverability.Therefore,by analyzing the current situation of the criminal network regulation in China's criminal law,and drawing lessons from the experience of foreign criminal legislation,this paper puts forward some suggestions for the deficiencies in legislation and judiciary.It makes the regulation of Chinese criminal law more realistic and operable on the network rumor behavior,and it can be legally prescribed by law.
