On The Tort Liability For Traffic Accidents Caused By The Sharing Of Bicycles

With the promotion of sharing economic model,the shared bicycle has become popular in the whole society,and the shared bicycle has brought about a series of social problems,economic problems and legal problems.There are more and more problems with the use of shared bicycles in everyday life.These issues need to be resolved in time,particularly in connection with the tort issues arising from the shared bicycle.In recent years,due to the problem of the shared bicycle defects caused by traffic accidents,some of the parties involved in the dispute have been more inclined to resort to the law.The problem of the infringement caused by the shared bicycle defects can't be solved well in the society,which is largely due to the lack of social management system construction and the imperfect legal system.After having a better understanding of the relationship between sharing of bicycle and traffic accidents,and having a certain understanding of the Tort Law of the People's Republic of China,we have a comparatively clear analysis and understanding of the tort problems caused by the shared bicycle defects.This paper makes a systematic analysis and elaboration on the tort liability of the traffic accident caused by the shared bicycle defects through a recent lawsuit.This paper introduces the shared bicycle,and analyzes its characteristics and the shared bicycle rental contract format text,points out the electronic fault problem in the shared bicycle,and explains the concept of traffic accident from the legal aspect,and analyzes the nature of the traffic accident liability cognizance and its influence on the tort liability,and analyze the traffic accident responsibility differentiates,properties and its influence on tort liability,as well as for shared bicycle flaw infringement caused by traffic accident,tort imputation principle,responsibility body,dispute resolving mechanism analyses.The writer also put forward some immature opinions,and hope that through this paper to offer help for other scholars in the theoretical research by the practice of solving the problem of shared bicycle flaw infringement caused by traffic accident.
