Due to the increasing minors crime rate and crime types,the deterioration of crime situation and the current scarcity of judicial resources could not be reconciled between the increasingly prominent contradictions.Under this situation,the system of conditional non prosecution will emerge as the times require.In our country in the new "Criminal Procedure Law" in 2012,it has made it clear that the minors with the conditions of non prosecution system,which is a great extent,is a kind of progress.This article from the conditional non prosecution system connotation and characteristics,on the theoretical basis of minors conditional non prosecution system,through to the Nanchang city A District Procuratorate are summarized in the acceptance of minors conditional non prosecution cases in the process of experience,our minors conditional non prosecution system still exist many problems such as the applicable scope of the case too narrow,the decision procedure is not clear,and to study the mechanism not perfect,the supervision mechanism is not in place,the relief mechanism is not perfect and other defects,put forward perfect suggestions,from the case to relax the application scope,perfect decision procedures,to strengthen the implementation of perfecting the system and mechanism,study and improve the supervision mechanism and improve the relief mechanism etc..I want to through this analysis,we hope to apply to the laws and regulations of our country in the minors conditional non prosecution system to improve the construction of the role,in order to realize the value of the system should be,and prompt the system to really play a larger role in the radiation in the judicial practice,and to protect the lawful rights and interests of minors.
