Study On The System Of Conditional Non-prosecution

The conditional non-prosecution system originated from the reform practice of grassroots organs.As early as the 1990 s,the state helped the minors who helped the crime through the youth help bases and community education.China ' s 2012 Criminal Procedure Law first established a conditional non-prosecution system for minors in the form of a special chapter.Although the system is not the first in the world,it does have great progress for China,but the system is There are imperfect and unspecified,lack of maneuverability in practice,and the inability to meet the needs of existing judicial practice.There are still major problems in the system.For example,the scope of applicable systems is too narrow and the applicable conditions are lacking.The decision procedures,and inspection supervision mechanisms are not perfect.Therefore,this paper mainly analyzes the theoretical basis on which the conditional non-prosecution is based,combines the effective experience of other countries and regions abroad,analyzes the existing problems of the existing system,proposes corresponding solutions,and makes the conditional non-prosecution system no longer just stay in theory.At the level,it is possible to design adolescents to develop healthily,to re-enter the life,study,and work on the right track,to make the society more harmonious,and to jointly build a perfect rule of law society.
